Terms of Service

Welcome to Your Cooking Corner. These Terms of Service (“Terms”) are a legally binding agreement between you (“you” or “User”) and Your Cooking Corner (“we,” “us,” or “our”), based in Nova Scotia, Canada.

By accessing or using the website at yourcookingcorner.ca or any related services (collectively, the “Service”), you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

1. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you are at least 16 years old and have the legal capacity to enter into these Terms. If you are between 16 and the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.

The Service is available worldwide, but certain features (such as paid subscriptions) may not be available in all jurisdictions. We reserve the right to limit the availability of the Service or any portion of it to any person, geographic area, or jurisdiction at any time.

2. Your Account

To access certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information to keep it accurate and complete.
• Maintain the security and confidentiality of your login credentials. You are solely responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, incomplete, or in violation of these Terms.

You may delete your account at any time through your account settings. Upon account deletion, we will delete your personal data in accordance with our Privacy Policy.

3. Description of the Service

Your Cooking Corner is a web-based recipe management and meal planning platform. The Service may include, but is not limited to:

• Recipe uploading, importing, creating, editing, and sharing.
• Automatic nutrition estimation for recipes.
• Automatic dietary and allergen categorization of recipes based on analysis of listed ingredients (e.g., nut-free, gluten-free, dairy-free, vegan).
• Meal planning and calendar-based nutritional tracking.
• Grocery list generation from planned meals.
• Custom printable cookbook creation.
• Social features including friend connections and recipe ratings.
• Snack and restaurant meal logging.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify users of significant changes in advance. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

4. Subscriptions and Payments

Subscription Plans

The Service offers both free and paid subscription tiers. Paid subscriptions provide access to premium features as described on our pricing page. Features available on each tier may change over time; we will notify existing subscribers before removing features from their current tier.

Billing and Payment

Paid subscriptions are billed in advance on a recurring basis (monthly or annually, as selected at the time of purchase). Payment is processed through our third-party payment processor, Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

All prices are displayed in the currency indicated at the point of purchase and are inclusive of applicable taxes unless otherwise stated. You are responsible for any applicable sales tax, GST/HST, VAT, or other taxes imposed by your jurisdiction.

Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period — you will continue to have access to paid features until your current billing period expires. We do not provide prorated refunds for partial billing periods.

If you believe you have been charged in error, please contact us within 30 days of the charge at yourcookingcornercontact@gmail.com and we will review your case.

Price Changes

We may change subscription prices from time to time. Any price changes will take effect at the start of your next billing period following notice of the change. If you do not agree with the new pricing, you may cancel before the next billing period begins.

Free Trials

We may offer free trial periods at our discretion. If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan at the advertised rate. We will not use negative option billing — you will always be clearly informed before being charged.

5. Free Tier and Advertising

The Service offers a free tier with limited features. Free accounts include a limited number of recipe imports. Additional imports and full feature access are available through a Premium subscription. The free tier is supported by advertising. By using the free tier, you agree that:

• We may display advertisements within the Service, including ads served by third-party advertising networks.
• Advertising content is provided by third parties and we do not endorse or guarantee the accuracy of any advertisements.
• You will not use ad-blocking technology to circumvent ads displayed within the Service. We reserve the right to limit functionality for users who block ads.

The Service may also include affiliate links to third-party products and services within recipes and other content. We may earn a commission from purchases made through these links at no additional cost to you.

6. User Content

Your Content

“User Content” means any content you submit, upload, post, or transmit through the Service, including but not limited to recipes, images, text, meal plans, ratings, comments, and cookbook configurations.

You retain ownership of your User Content. We do not claim ownership of any content you create or upload to the Service.

License Grant

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, display, and distribute your User Content solely for the purpose of operating, providing, improving, and promoting the Service. This license continues until you delete the content or your account, at which point we will cease use within a commercially reasonable time, except where we are required to retain it for legal purposes.

If you use social or sharing features of the Service (such as sharing a recipe with friends or making a recipe public), you grant other users of the Service a non-exclusive license to view and, where the feature permits, save or print your shared content for personal, non-commercial use.

Content Representations

By submitting User Content, you represent and warrant that:

• You own the content or have the necessary rights, licenses, and permissions to submit it and grant the licenses described above.
• Your content does not infringe or violate any third party's intellectual property rights, privacy rights, or any applicable law.
• Your content does not contain any material that is defamatory, obscene, threatening, or otherwise objectionable.

Content Removal

We reserve the right (but have no obligation) to review, monitor, or remove User Content at our sole discretion, including content that we believe violates these Terms, infringes intellectual property rights, or is otherwise objectionable. We are not responsible for any User Content submitted by users of the Service.

7. Intellectual Property

The Service and its original content (excluding User Content), features, functionality, design, graphics, logos, and software are and shall remain the exclusive property of Your Cooking Corner and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws of Canada and international jurisdictions.

You may not copy, modify, distribute, sell, lease, or create derivative works based on the Service or any part thereof without our prior written consent. You may not reverse engineer, decompile, or disassemble any part of the Service.

The name “Your Cooking Corner,” our logo, and all related names, logos, product and service names, designs, and slogans are our trademarks or those of our affiliates. You may not use such marks without our prior written permission.

8. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates any applicable federal, provincial, state, local, or international law or regulation.
• Attempt to gain unauthorized access to any portion of the Service, other user accounts, or any systems or networks connected to the Service.
• Use any automated system, including but not limited to bots, scrapers, or crawlers, to access the Service for any purpose without our express written consent.
• Upload or transmit any viruses, malware, or other harmful code.
• Interfere with or disrupt the Service or the servers or networks connected to the Service.
• Impersonate or attempt to impersonate another user, person, or entity.
• Use the Service to send unsolicited communications, spam, or advertising.
• Collect or harvest any personally identifiable information from other users of the Service.
• Use the Service to engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service.
• Circumvent, disable, or otherwise interfere with security-related features of the Service, including features that prevent or restrict the use or copying of any content.
• Use the Service to develop a competing product or service.
• Upload content that you do not have the right to share, including copyrighted recipes, images, or other material belonging to others without their permission.

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this section, including without limitation, suspending or terminating the offender's account and reporting them to law enforcement authorities.

9. Copyright and Takedown Notices

Canadian Notice-and-Notice Regime

We comply with the notice-and-notice provisions of the Canadian Copyright Act (sections 41.25-41.27). If a copyright owner believes that content on the Service infringes their copyright, they may send a notice of claimed infringement to us. We will forward such notices to the user who posted the content in question, as required by Canadian law.

DMCA Compliance (for U.S. Copyright Holders)

For copyright holders in the United States, we also respect the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work has been reproduced on the Service in a way that constitutes copyright infringement, please send a written notice to our designated agent containing:

• A description of the copyrighted work you claim has been infringed.
• A description of where the allegedly infringing material is located on the Service (including a URL if possible).
• Your contact information (name, address, telephone number, and email address).
• A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
• A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.

Repeat Infringers

We maintain a policy of terminating the accounts of users who are repeat copyright infringers, in appropriate circumstances and at our sole discretion.

10. Third-Party Services and Links

The Service may contain links to or integrations with third-party websites, services, or content (including but not limited to payment processing via Stripe, recipe import from external websites, and affiliate product links). These third-party services are not under our control, and we are not responsible for their content, privacy policies, practices, or availability.

Your interactions with third-party services are governed by that third party's own terms and policies. We strongly encourage you to review the terms and privacy policies of any third-party service you interact with through the Service.

The inclusion of any link or integration does not imply our endorsement, sponsorship, or recommendation of the linked service or its content.

11. AI-Powered Features

The Service uses artificial intelligence to provide certain features, including but not limited to automatic nutrition estimation, recipe extraction from images and videos, and recipe formatting.

By submitting content for AI processing (such as images of recipes for extraction), you acknowledge that this content may be sent to third-party AI service providers for processing. These providers process your content solely to generate results for you and are contractually prohibited from using your content for training their models.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by applicable law, we expressly disclaim all warranties, whether express, implied, statutory, or otherwise, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Any warranties that the Service will be uninterrupted, timely, secure, or error-free.
• Any warranties regarding the accuracy, reliability, or completeness of any content on the Service, including nutrition information, recipe data, or AI-generated content.
• Any warranties that defects will be corrected or that the Service or the servers that make it available are free of viruses or other harmful components.

No advice or information, whether oral or written, obtained from us or through the Service, shall create any warranty not expressly stated in these Terms.

Nutrition and Health Disclaimer: The Service provides nutrition estimates, automated dietary categorizations, and dietary tracking features for general informational purposes only. This information is not intended as medical or nutritional advice and should not be used as a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider or registered dietitian before making dietary decisions, especially if you have allergies, intolerances, or health conditions.

Automated Dietary Categorization Disclaimer: The Service automatically categorizes recipes by dietary attributes (such as nut-free, gluten-free, dairy-free, or vegan) based on automated analysis of listed ingredients. These categorizations are estimates only and are not guaranteed to be accurate or complete. They do not account for cross-contamination, unlisted sub-ingredients, brand-specific formulations, or ingredients described in non-standard terms. Users with allergies, intolerances, or dietary restrictions must independently verify all ingredients before preparing or consuming any recipe. We are not responsible for any adverse health effects resulting from reliance on automated dietary categorizations.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL YOUR COOKING CORNER, ITS OWNER, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.
• Damages arising from: (a) your access to or use of (or inability to access or use) the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service, including AI-generated content or nutrition estimates; (d) unauthorized access, use, or alteration of your transmissions or content; (e) any errors, inaccuracies, or omissions in any content; or (f) any health consequences resulting from dietary decisions made based on information provided by the Service.

IN ANY EVENT, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY CANADIAN DOLLARS (CAD $50.00).

The limitations and exclusions in this section apply regardless of the theory of liability, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

14. Indemnification

You agree to defend, indemnify, and hold harmless Your Cooking Corner, its owner, affiliates, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to legal fees) arising from:

• Your use of and access to the Service.
• Your violation of any provision of these Terms.
• Your violation of any third-party right, including any intellectual property, privacy, or proprietary right.
• Any User Content you submit, post, or transmit through the Service.
• Any claim that your User Content caused damage to a third party.

This indemnification obligation will survive the termination of these Terms and your use of the Service.

15. Termination

Termination by You

You may terminate your account at any time by deleting your account through your account settings or by contacting us at yourcookingcornercontact@gmail.com. If you have an active paid subscription, cancellation of your account will also cancel your subscription. You will not receive a refund for any remaining time on your current billing period.

Termination by Us

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

Effect of Termination

Upon termination, we will delete your account data in accordance with our Privacy Policy. The following sections of these Terms shall survive termination: User Content (license grants for content shared prior to termination), Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Dispute Resolution and Governing Law, and any other provisions that by their nature should survive.

16. Dispute Resolution and Governing Law

Governing Law

These Terms and any dispute arising out of or relating to the Service shall be governed by and construed in accordance with the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Informal Resolution

Before initiating any formal dispute resolution proceeding, you agree to first contact us at yourcookingcornercontact@gmail.com and attempt to resolve the dispute informally for at least 30 days. Most disputes can be resolved through good-faith communication.

Jurisdiction

If informal resolution fails, any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the courts of the Province of Nova Scotia, Canada, and you irrevocably consent to the jurisdiction of such courts. Notwithstanding the foregoing, we may seek injunctive or equitable relief in any court of competent jurisdiction to protect our intellectual property rights.

Class Action Waiver

To the fullest extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this class action waiver is found to be unenforceable in your jurisdiction, this entire dispute resolution section (except the governing law provision) shall be void with respect to you.

17. Consumer Rights

Nothing in these Terms is intended to exclude or limit any mandatory consumer protection rights that apply to you under the laws of your jurisdiction and that cannot be waived or limited by contract. This includes, but is not limited to:

• Nova Scotia and Canadian consumers: Your rights under the Nova Scotia Consumer Protection Act, including rights related to internet sales contracts, cannot be waived. If any provision of these Terms conflicts with mandatory consumer protection legislation in your province, the legislation prevails.
• European Economic Area consumers: If you are a consumer in the EEA, you benefit from mandatory provisions of the consumer protection laws of your country of residence. Nothing in these Terms affects your rights as a consumer under those laws, including your right to withdraw from distance contracts within 14 days under the EU Consumer Rights Directive. You also have the right to bring proceedings in the courts of the member state in which you are domiciled.
• United Kingdom consumers: If you are a consumer in the UK, your statutory rights under the Consumer Rights Act 2015 are not affected by these Terms. Any terms found to be unfair under that Act will not be binding on you.
• Australian consumers: If you are a consumer in Australia, nothing in these Terms excludes, restricts, or modifies any consumer guarantee or other right or remedy under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded, restricted, or modified by agreement.
• Other jurisdictions: If mandatory consumer protection laws in your jurisdiction provide you with rights or remedies that cannot be excluded or limited, those rights and remedies are preserved regardless of anything in these Terms.

18. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the “Effective Date” at the top of this page.
• Provide notice through the Service (such as a banner or pop-up notification) or by sending you an email.
• For changes that materially affect your rights or obligations, we will provide at least 30 days' notice before the changes take effect.

Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and may delete your account.

19. Severability and Entire Agreement

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be modified, it shall be severed from these Terms. The invalidity of any provision shall not affect the validity and enforceability of the remaining provisions.

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or policies published on the Service, constitute the entire agreement between you and Your Cooking Corner regarding the Service and supersede all prior agreements, representations, and understandings.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
